Terms of Service

1. Who you're dealing with

These terms are an agreement between you and OnePlankton (reg. No. 1238924), a self-employed enterprise registered in Lithuania (individuali veikla), registered address 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("ToyAI", "we", "us"). Contact: support@bentleyhugs.com. By creating an account, placing an order, or using a ToyAI device, you accept these terms. Nothing in them limits the rights you have as a consumer under EU and national law.

2. What ToyAI is

ToyAI sells plush toys with an embedded voice unit, a send-in service that installs the voice unit into your child's existing plush, a retrofit kit, and optional add-ons such as a custom voice. The voice unit lets a child have spoken conversations with an AI companion. A parent dashboard gives the account holder full conversation transcripts, topic filters, quiet hours, alerts, and data controls.

The AI conversation features require an active monthly subscription (currently €9.99/month). Without an active subscription the toy remains a normal plush toy, but the AI voice features and dashboard monitoring are unavailable. We say this clearly before you buy, on the product and pricing pages.

AI responses are generated automatically. We layer safety filtering, age-appropriate prompting, and parental controls on top, but no AI system is perfect — see Sections 5 and 8.

3. Your account

You must be at least 18 and the parent or legal guardian of any child whose profile you create. Keep your login credentials private; you are responsible for activity under your account. Provide accurate information and keep it up to date.

4. Orders, prices, and subscription

Prices are shown in euros and include VAT where applicable. An order is accepted when we confirm it by email. Obvious pricing errors may be corrected before dispatch; in that case you may cancel for a full refund.

The subscription renews monthly and can be cancelled at any time from the dashboard, effective at the end of the current billing period. Price changes will be announced at least 30 days in advance and only take effect from your next billing period — if you disagree, simply cancel before they apply. 5. Parent responsibility and consent

By creating a child profile and enabling conversations you confirm that you are the child's parent or legal guardian and that you consent to the processing of your child's data as described in our Privacy Policy. You are responsible for reviewing the dashboard, configuring filters and quiet hours appropriately for your child, and supervising your child's overall use of the toy. ToyAI is a companion toy — it is not a babysitter, a medical or psychological device, an emergency service, or a substitute for parental care.

6. Acceptable use

You agree not to:

  • attempt to make the AI produce content that is harmful to children, or use the device with the safety systems disabled or circumvented;
  • reverse engineer, tamper with, or extract the device firmware or our services, except where the law expressly permits it;
  • use the service to record people without the consent required by law, or otherwise violate anyone's privacy;
  • resell access to the subscription, abuse our APIs, or interfere with the operation or security of the service;
  • upload a custom voice sample without the clear permission of the person whose voice it is.

We may suspend or terminate accounts that materially breach these terms, after notice where the law requires it.

7. Warranty

Hardware (the toy, voice unit, and retrofit kit) carries a 1-year manufacturer warranty against defects in materials and workmanship. This is in addition to, and does not limit, your EU legal guarantee of conformity (minimum 2 years): if the product is faulty or not as described, you are entitled to repair, replacement, a price reduction, or a refund as provided by law. The warranty does not cover normal wear, machine-washing the voice unit, or damage from misuse or unauthorised modification.

8. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, or for anything else that cannot be excluded under applicable law — including your statutory consumer rights.

Subject to that, we are liable only for foreseeable damage caused by our breach of these terms, and our total liability is capped at the greater of the amount you paid us in the 12 months before the event giving rise to the claim and €200. We are not liable for events outside our reasonable control (e.g. internet or third-party AI provider outages), though your statutory remedies for lack of conformity remain unaffected.

AI-generated responses are produced automatically and may occasionally be inaccurate. The parental controls and transcripts exist precisely so you can verify what the toy says.

9. Intellectual property

We (and our licensors) own the software, firmware, branding, and content of the service. You get a personal, non-transferable licence to use the software embedded in your device and the dashboard for your family's private use. Your data remains yours — see the Privacy Policy.

10. Changes to the service or these terms

We may update the service and these terms. For material changes we will give you at least 30 days' notice by email. If you do not agree with a change, you may cancel your subscription before it takes effect.

11. Governing law and disputes

These terms are governed by the laws of the Republic of Lithuania and applicable EU law. If you are a consumer, you also enjoy the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country.
